Terms of Service
The agreement between you and us
These Terms of Service form a binding agreement between you and K S shree kamesh ("we", "us"), the operator of the marketplace ShopLove. By creating an account, placing an order, or otherwise using the website or mobile application (together, the "Services"), you accept these terms. If you do not accept them, do not use the Services.
We operate a marketplace
Products listed here are sold by independent third-party sellers, not by us. The contract of sale for any item is formed directly between you and that seller. We provide the platform, collect payment on the seller's behalf, and administer the cancellation, return and refund process described in our published policies.
1 Eligibility and Acceptance
You must be at least 18 years old and legally able to enter into a contract under the Indian Contract Act, 1872. A minor may use the Services only through a parent or guardian who accepts these terms on their behalf and is responsible for the account.
We may amend these terms at any time. The revised version takes effect when posted on this page, and the "Last Updated" date above will change. Continuing to use the Services after that means you accept the revision. Orders already placed are governed by the terms in force when the order was confirmed.
2 Your Account
You agree to:
- Give accurate, current and complete information when you register, and keep it up to date
- Keep your password and any OTP confidential and not share your account
- Accept responsibility for everything done through your account
- Tell us at once if you suspect unauthorised access
We may suspend or close an account that breaches these terms, is used for fraud, or is used to place repeated orders that are refused on delivery. Where we do so, any amount you have already paid for goods not delivered is refunded to you.
3 Products, Pricing and Order Acceptance
Listings: product descriptions, images and specifications are supplied by the seller. We take reasonable care but do not warrant that every listing is accurate, complete or current.
Pricing: prices are shown in Indian Rupees and include applicable taxes unless stated otherwise. Shipping is added at checkout and shown before you pay. Prices may change without notice, but never after you have confirmed an order.
Order acceptance: your order is an offer to buy. It is accepted only when we confirm dispatch. If an item is out of stock, mispriced through an obvious error, or your address is not serviceable, we may decline the order and will refund you in full within 5-7 business days.
Availability: all items are subject to availability, and a seller may withdraw a listing at any time.
4 Payments
By placing an order you agree to pay the full amount shown at checkout, including taxes and shipping. Payment methods available to you are displayed during checkout and may include cards, UPI, net banking, wallet balance and cash on delivery.
Payments are processed by third-party gateways that are PCI-DSS certified. We do not receive or store your card number, CVV or UPI PIN. If a payment is debited but your order does not confirm, the amount is either auto-reversed by your bank or refunded by us within 5-7 business days of the failed transaction being identified.
5 Shipping, Cancellation and Refunds
Delivery timeframes and how shipping charges are calculated are set out in our Shipping Policy. Your right to cancel, the 7-day return window, the absence of any restocking fee, and refund timelines are set out in our Cancellation, Return & Refund Policy. Both policies form part of these terms.
6 Acceptable Use
You must not:
- Use the Services for any unlawful purpose, or to buy goods you intend to resell in breach of law
- Place orders using someone else's payment instrument without authority
- Post reviews or content that is false, defamatory, obscene, or infringes someone's rights
- Attempt to gain unauthorised access to the Services, scrape them at scale, or disrupt their operation
- Reverse engineer, copy or resell any part of the platform
7 Intellectual Property
The platform's software, layout, graphics and text are owned by K S shree kamesh or its licensors and are protected by copyright and trade mark law. Product images and brand marks belong to the respective sellers or brand owners. Nothing here grants you a licence to use any of it commercially. Content you submit, such as a review or a photo attached to a return, remains yours, but you grant us a non-exclusive, royalty-free licence to display it on the platform in connection with the relevant product or request.
8 Disclaimers and Limitation of Liability
The Services are provided on an "as is" and "as available" basis. We do not warrant that the platform will be uninterrupted or error-free.
What we are responsible for: operating the platform, processing your payment correctly, and administering cancellations, returns and refunds in line with our published policies.
What the seller is responsible for: the quality, safety, legality and description of the goods, and any warranty attached to them.
Cap on liability: to the extent permitted by law, our total liability to you for any claim connected with an order is limited to the amount you paid for the item giving rise to that claim. We are not liable for indirect, incidental, special or consequential loss, including loss of profit, business or data.
What is not limited: nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Your statutory rights as a consumer under the Consumer Protection Act, 2019 are unaffected by these terms.
9 Indemnity
You agree to indemnify us against any claim, loss or expense arising from your breach of these terms, your misuse of the Services, or your infringement of another person's rights.
10 Governing Law and Disputes
These terms are governed by the laws of India. Before starting formal proceedings, please raise the matter with our grievance contact below; we aim to acknowledge within 48 hours and resolve within 30 days.
Any dispute that cannot be resolved that way is subject to the exclusive jurisdiction of the courts having jurisdiction over our registered address, stated below.
11 Severability
If any provision of these terms is held to be invalid or unenforceable, the remaining provisions continue in full force.
